Terms of Use
Rules for using the FIXER service. Effective date: 22 October 2026.
This is a translation provided for convenience. In case of any discrepancy, the Polish version prevails.
TERMS OF USE
OF THE FIXER SERVICE
1. General provisions
- These Terms set out the rules for using the FIXER service, including the website and the web application (PWA), which is used in particular to record, discuss and approve work in renovation or fit-out projects.
- The provider of the service (the “Provider”) is Mariusz Woźniak. Contact for matters concerning the service: [email protected].
- The Terms are made available before the agreement for using the Service is concluded, in a way that allows their content to be saved and reproduced.
- The Service is intended primarily for small teams carrying out a renovation or fit-out of an apartment. It is not a system for running a large construction site, nor a tool for settling payments.
- FIXER is not a party to any agreement concluded between the project owner, the investor, the designer, the contractor or any other participants. The Terms do not replace any agreement concluded between those persons.
2. Definitions
- Service / FIXER — the fixerapp.eu website and the FIXER application, including the PWA features available at a given time.
- User of the Service (also the “User”) — a person using the Service under the rules described in the Terms.
- Project — a renovation or fit-out undertaking in which Users of the Service and Project Participants enter changes, quotes, tasks, comments and decisions, according to the permissions granted in the Projects.
- Project Owner — a user who sets up a project for business purposes, manages it and invites other persons to it.
- Project Participant (also the “Participant”) — a person invited to a project who has accepted the invitation and gained access to the project.
- Project Content — texts, photos, files, comments, quotes, tasks, approvals and other information entered into the Service by a User or Project Participant.
- Test — the temporary, free programme for testing FIXER described in § 5.
3. Types and scope of services
- Depending on the current version, the Service may enable:
- registration of the User of the Service and of Project Participants;
- enabling the Project Owner to create and manage Projects, i.e.:
- inviting Participants;
- assigning project roles — designer, contractor or investor — and managing access to the project;
- enabling the Project Owner and Project Participants to:
- record work, quotes, comments, tasks and decisions in the Project;
- use limited offline features, synchronise after the connection is restored and download a copy of the project data;
- report errors, give feedback and receive notifications.
- In every project a Project Participant is assigned a role. The current limits on the number of Project Participants and roles are shown in the Service.
- The Service documents information and decisions recorded by Users of the Service. It does not settle disputes, determine whether entries are true, approve the quality of work or carry out settlements between the parties.
- A report or export shows the data recorded in the Service. It does not replace a contract, an invoice, an acceptance protocol or any other document required by law or agreed by the parties.
- The scope of features may change, especially during the test period. Information about a significant restriction or withdrawal of a feature will be given in the Service or directly to the Users of the Service concerned.
4. Technical requirements and rules of use
- Using the Service requires: a device with internet access, an up-to-date browser that supports modern web applications, and JavaScript and the browser storage needed for the Service to work enabled.
- Some features may require installing the PWA, allowing notifications or network access. Offline features are limited and do not replace a permanent connection to the Service. Requirements for specific devices and browsers are given in the FAQ.
- The User should use up-to-date software, protect the device and login details, and not leave an account open on a shared device.
- The User may not deliver unlawful content or malicious software through the Service, or content that infringes the rights of third parties. The User may not attempt to gain unauthorised access, disrupt the operation of the Service or bypass its security measures.
- The User may stop using the Service at any time. Ending work offline before synchronisation may result in the loss of local changes that have not yet been sent.
5. Conclusion of the agreement and rules of the Test
- The agreement for the provision of services by electronic means is concluded once the Terms have been displayed to the User and actively accepted in the Service, and an account has been created or an invitation accepted — depending on how use begins.
- A project user accepts the Terms before starting to use their account. Sending an invitation does not mean that the invited person has accepted the Terms or created an account.
- After first logging in, the Project Owner can use the test version, which lasts 4 weeks, is free of charge and does not require the Project Owner to provide a payment card. The Test period starts with the first activity in the application: adding the first change or accepting the first invitation — whichever happens first.
- After the test period ends, the accounts of Users and the Projects linked to the account of a Project Owner that has not paid switch to a mode that only allows downloading a report. The User can download, for 7 days, a copy of the information they entered, and the Project Owner can download the complete record of data in the Project. The Project Owner’s account, together with the data of the Projects created by them, is deleted 90 days after the end of the Test or 90 days after they stop using the Service.
6. Account, invitations and access to the project
- The User provides the true and current data required to create an account, including an e-mail address. The e-mail address is needed to run the account, for logging in or for sending an invitation.
- The project owner is responsible for choosing the persons they invite and for granting and withdrawing the appropriate permissions in the Project.
- Before passing on the data of an invited person, the Project Owner should have a basis for using it and should give that person the information about data processing required by law. The invitation states who sent it and which project it concerns, and makes the Terms of the Service available for acceptance.
- The User may not share their login details with other persons. They should notify the Provider without delay of any suspected unauthorised access.
- Removing a Participant from a project, deleting an account and deleting project content are separate actions. Their effects depend on the User’s role, the rights of the other Participants and the features available in the Service. Deleting a Participant’s account does not automatically delete the project history.
7. User content and intellectual property rights
- The User retains the rights to the Project Content they enter into the Service. The User grants the Provider a non-exclusive, free-of-charge authorisation, limited in time and scope to what is needed to provide the Service, to store, technically process, display to authorised Participants, synchronise and export that content.
- The authorisation under paragraph 1 does not give the Provider the right to use Project Content in advertising or to publish it outside the project, unless the User gives separate consent or this results from legal provisions.
- The User declares that they have the right to enter the Project Content and to make it available to the persons designated in the project. The User is responsible for the content of their entries and for ensuring that their use complies with the law and with the rights of third parties.
- Special categories of data, such as health data, or data relating to criminal convictions or offences, should not be entered into the Service.
- The rights to the application, code, layout, marks and materials of the Provider remain with the Provider or its licensors. The User may use them only to the extent needed for ordinary use of FIXER.
8. Personal data and the roles of the parties
- Information on the data that the Provider of the FIXER Service processes for its own purposes, such as account administration, handling participation in Tests, correspondence, security of the Service and handling of reports, can be found in the FIXER Privacy Policy (https://fixerapp.eu/polityka-prywatnosci).
- Project Content may contain data of Participants, contractors, clients, property owners or other persons. The controller of the personal data contained in Project Content, including the data of Project Participants, is the Project Owner, and the processor is the Provider of the FIXER Service.
- The Provider processes personal data relating to project content in accordance with the terms of the data processing agreement concluded under Article 28 GDPR. The data processing agreement is available at https://fixerapp.eu/umowa-powierzenia (in Polish; the Polish version is binding). The Terms do not replace such an agreement, and its content is made available for acceptance by the Project Owner before or when the account is set up in the Service.
- Before entering the data of other persons into a project, every User should limit it to the necessary minimum and make sure that the relevant controller has a legal basis and has fulfilled its information obligations.
- If the User uses FIXER solely for personal or household purposes, the application of the data protection provisions is assessed in accordance with the law.
- The above provisions do not transfer to the User any obligations that are borne by the Provider by law.
9. Offline work, export and data backups
- FIXER may display the most recently loaded project information offline and store some data in the browser storage on the User’s device. Changes made offline are sent when the connection is restored; until then they may not be visible to other Participants.
- The User should check that changes have been synchronised before closing the project, clearing the browser storage, uninstalling the PWA or changing device. Deleting local data may delete unsynchronised entries or the local copy.
- The project copy available in the Service may include the timeline of changes, comments and the task list. The application may verify the digital signature of an export when it is loaded again. The scope of the export is given in the Service.
- Backups of the Provider’s infrastructure serve to restore the Service after a failure and do not guarantee that a single project will be restored on individual request. The User should download their own copy using the features made available in the Service.
- Detailed information on local storage, retention and deletion of data is contained in the Privacy Policy (https://fixerapp.eu/polityka-prywatnosci) and — as regards entrusted data — in the data processing agreement.
10. Contact via Facebook, Instagram and Messenger
- The User may voluntarily contact FIXER by e-mail, via the FIXER profile on Facebook or Instagram, or via Messenger. Whether a reply is available depends on how the given channel works; using these channels is not required to use the application.
- Meta platforms are separate services and may process data under their own rules. The User should read the terms and privacy policies of those providers. Sensitive data or confidential project information should not be included in messages unless necessary.
- FIXER may send commercial or marketing information through electronic channels only after obtaining the prior consent required by law. Merely having a FIXER account, taking part in a project, the public availability of a profile or an earlier conversation does not automatically constitute marketing consent. Marketing consent is separate from acceptance of the Terms.
- Details of data processing in these channels and the User’s rights are described in the Privacy Policy (https://fixerapp.eu/polityka-prywatnosci).
11. Fees and future offers
- Using FIXER during the Test period is free of charge and does not require payment card details.
- Using FIXER as a Project Participant takes place under the subscription fees paid by the Project Owner.
- Access to a paid service takes place in accordance with the subscription plan chosen by the Project Owner.
12. Reports and complaints
- Comments, errors and complaints concerning the operation of the Service can be reported through the “Report a bug” feature or to [email protected]. Where possible, a report should include the account e-mail address, the project name, a description of the problem, the date it occurred and information on how it can be reproduced. Passwords or unnecessary personal data should not be sent.
- The Provider will confirm receipt of and respond to a report within 14 days of receiving it, unless mandatory provisions of law provide otherwise. If additional information is needed to examine the matter, the Provider may ask for it to be supplied.
- If the User is a consumer, this procedure does not limit the rights and complaint periods to which they are entitled under the provisions on the conformity of digital content or a digital service with the contract.
- A report concerning content or data recorded in a project may require contact with the Project Owner.
13. Availability, interruptions and liability
- A Service made available in a test version may contain errors, be temporarily unavailable or have limited features. The Provider takes reasonable steps to maintain and secure the Service and to give notice of planned interruptions where possible.
- The Provider is not a party to a contract for works, a supply of materials or any other contract concluded by Users. It does not verify the truth of arrangements, cost estimates, entries or approvals. The authors of their own arrangements and the parties to the given contract are responsible for their content and effects.
- FIXER does not settle payments between Users, does not guarantee that work will be carried out, and is not legal, technical or construction advice. Users should assess for themselves whether an entry or report is sufficient for their purpose and keep the documents required by their contract or by law.
- No provision of the Terms excludes or limits the Provider’s liability to the extent that such exclusion or limitation would be impermissible under the law, in particular mandatory consumer rights.
14. Suspension, ending use and deletion of the account
- The User may stop using FIXER at any time and ask for the account to be deleted by sending a message to [email protected].
- The project owner may end use of the project; before doing so they should download the data they need and inform the Participants. The effects on project content, history and the data of other persons depend on their rights and on the relevant data controller.
- The Provider may temporarily restrict access to the Service to the extent necessary to remove a security threat, carry out urgent technical work, fulfil a legal obligation or respond to a significant breach of the Terms. The restriction will be proportionate, and the User will be informed in advance where this is possible and lawful.
- The end of the Test, the switch to a mode that only allows downloading a report, the deletion of an account and the deletion of a project are different events. Retention and deletion of data from active systems and backups are governed by the Privacy Policy and — in the case of entrusted data — by the data processing agreement.
15. Changes to the Terms
- The Provider may change the Terms if the features of the Service, the law or the way the service is provided change, or if errors need to be corrected. The current version and the effective date will be published on the Terms page.
- The Provider will inform the User of a significant change in good time through the Service or by e-mail, stating the date on which the change takes effect. If the User does not accept the change, they may stop using the Service before that date and ask for the account to be deleted.
- A change to the Terms does not affect acquired rights or mandatory consumer rights. If the law requires renewed consent, the Provider will ask for it before continuing to provide the service on the new terms.
16. Final provisions
- Matters not regulated here are governed by Polish law, subject to the provisions protecting consumers that apply regardless of the choice of law.
- If any provision proves invalid or ineffective, the remaining provisions remain in force to the extent permitted by law.
- The Terms apply from the date shown on the Terms page. Their current content is made available in a form that allows the User to save and reproduce it.
- Contact with the Provider of the FIXER Service: [email protected].
